Acceptance

By using emberandoak.top (the "Site") or placing an order with Ember & Oak Burger Co. ("we", "us", "our"), you agree to these Terms of Service. If you don't agree, please don't use the Site.

Online orders

Online orders are requests to purchase. A contract is formed when we confirm your order by phone or in person. We reserve the right to decline any order for any lawful reason, including:

• Item unavailability.
• Incorrect pricing or product information.
• Suspected fraud or abuse.
• Delivery outside our service radius.

No online payment

We currently do not process online payments. Payment is made in person at pickup or on delivery. Accepted methods include cash, major credit cards and mobile wallets. If you place an order online and do not show up, we may decline future online orders.

Pricing

Menu prices shown on the Site are in US dollars and are subject to change without notice. Sales tax, delivery fees and any applicable surcharges are shown at checkout or at pickup.

Order acceptance and cancellation

You may cancel your order by calling us at +1 (207) 340-1011 before the kitchen begins preparation. Once preparation has begun, we may not be able to cancel the order. If we cancel your order for our own reasons, we won't charge you anything.

Delivery

Delivery is available within a local radius for orders over $25. Delivery times are estimates and not guarantees. Someone of legal age must be present to receive the order. Our delivery partners follow state and local laws.

Pickup

Pickup orders are held at the counter during operating hours. If you don't pick up within 24 hours and don't contact us, we may discard the order. No refund is available in that case.

Allergens and dietary needs

Our kitchen handles gluten, dairy, eggs, soy, tree nuts, peanuts, fish and shellfish. We cannot guarantee zero cross-contamination. If you have a severe allergy, it is your responsibility to contact us before ordering. Allergen details are on the Nutrition page.

Rewards program

Oak Points is our free loyalty program. Points are earned one per qualifying order and are non-transferable. Points have no cash value. We reserve the right to modify or terminate the program with reasonable notice.

Gift cards

Gift cards are redeemable in-store only, have no expiration, and are not refundable or exchangeable for cash (except as required by law). Lost or stolen cards cannot be replaced without proof of purchase.

Intellectual property

All content on the Site — text, images, logos, code — is owned by Ember & Oak Burger Co. or licensed to us. You may not copy, reproduce or redistribute it without our written permission, except for personal non-commercial use (e.g. printing a menu page).

User submissions

By sending us a message, review, photo or other content, you grant us a non-exclusive, royalty-free, worldwide license to use it in connection with our business (e.g. social media, marketing). We will never use your personal contact details in public content without your permission.

Acceptable use

You agree not to use the Site in a way that is unlawful, harmful, or that interferes with its normal operation. Do not attempt to access non-public parts of the Site, submit false orders, or scrape data.

Disclaimers

The Site is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Site will be error-free or uninterrupted.

Limitation of liability

To the maximum extent permitted by law, Ember & Oak Burger Co. is not liable for indirect, incidental, special or consequential damages arising from your use of the Site or our services. Our total liability for any claim is limited to the amount you paid us for the specific order giving rise to the claim.

Governing law

These Terms are governed by the laws of the State of Maine, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Somerset County, Maine.

Changes

We may update these Terms occasionally. When we do, we'll change the "Last updated" date. Material changes will be highlighted on the homepage for at least 14 days. Continued use of the Site after changes means you accept the new Terms.
